Represented manufacturer-marketer of popular hydraulic steering product for outboards in patent infringement litigation before the U.S. District Court in Tampa, involving three patents earlier obtained by the firm for our client. Secured final injunction by Consent Decree against defendant's manufacture and sale of infringing product. Later represented major manufacturer of such product in litigation for breach of contract and contempt of court by the infringer, securing substantial cash settlement for our client.
Represented defendants' interests before the U.S. District Court in Madison in contentious patent infringement lawsuit dealing with microprocessor-based electro-mechanical dispensers. Among other things, developed demonstrative evidence establishing that accused product operates outside claims of the patent in suit -- leading to successful resolution of lawsuit by settlement, freeing client to continue with its electro-mechanical dispensers.
Represented corporation engaged in rapid prototyping against patent infringement charges filed by polymer-supplier subsidiary of major corporation before the U.S. District Court in Milwaukee. Secured summary judgment defeating infringement charges; prosecuted antitrust claims for an illegal "tying" arrangement, securing a favorable settlement for the client.
Defended manufacturer and marketer of unique automatic swimming pool cleaner against infringement charges brought by major competitor before the U.S. District Court in Miami; secured dismissal of all (three) infringement counts. In same suit, filed counterclaim against plaintiff's pool cleaner for infringement of our client's own patent rights; secured preliminary injunction on counterclaim, which was subsequently affirmed on all points by the U.S. Court of Appeals for the Federal Circuit. A permanent injunction was secured.
Represented creators of unique patented automatic swimming pool cleaner in complex litigation (involving breach-of-contract, tortious interference and declaratory judgment claims) in Florida state court in Orlando against opponent seeking to undermine client's position. The case involved disputed ownership claims with respect to eleven patents. After two-week trial, obtained jury verdict in favor of client's ownership.
Defended importer of track-lighting products in lawsuit brought by competitor in the U.S. District Court in Chicago, alleging infringement of design patent rights and federal trademark registrations relating to designs of imported track-lighting products. Developed defenses resulting in favorable resolution by settlement -- with our client continuing in such business.
Represented company that created unique connector for leads used in epilepsy brain-mapping in patent case in the U.S. District Court in Milwaukee against infringer of client's patent on such connector. Obtained summary judgment of infringement and final injunction against the infringing company.
Defended company that manufactures and markets patented subdural strip electrodes for epilepsy brain-mapping against declaratory judgment lawsuit, brought in U.S. District Court in Minnesota, by competitor seeking to invalidate client's patent; competitor's attack on client's patent was defeated. Filed counterclaim for infringement against competitor's product and secured injunction by Consent Decree, ending competitor's infringement.
Represented Wisconsin company in complex lawsuit before U.S. District Court in Baltimore involving claims and counterclaims regarding ownership of patent rights (relating to certain naturally-occurring pesticide extractions and the use thereof) against breach of contract, tortious interference and fraud charges by major contracting company. Extended litigation was resolved with affirmation of client's contract position and patent rights and substantial payments to client.
Represented creator of intravenous bag invention against major medical products company in lawsuit before the U.S. District Court in Milwaukee regarding disputed ownership and inventorship claims to the invention. Secured ruling confirming ownership by client and financial settlement. In addition, represented client in related Patent & Trademark Office (PTO) matters, including defeating public-use proceedings brought by medical products company against client's patent rights. Later represented client in licensing of rights to another major company in the industry.
Represented corporate defendant before the U.S. District Court in Milwaukee in patent infringement case involving flow-meter technology. Secured stay-of-proceedings based on evidence and later secured invalidity evidence and applied it against plaintiff's patent to secure full dismissal of the case.
